Whereas, the folks in the first picture are a lot closer to being "Native Americans" -- in fact they probably are! Given the migration patterns, they no doubt have North America ancestors!

Exactly, in fact, if they were born accross the northern boarder, under the Jay Treaty, they would not be excludeable.
